Terms and Conditions

These Terms and Conditions govern your relationship with Bendy Fitness Studios, including, but not limited to, your use of the Bendy Fitness Studios’ website www.bendyclass.com (the “Website”), your purchase of Bendy Fitness Studios classes or other services offered by Bendy Fitness Studios, your rights to cancel your purchase of classes or other services, your registration for classes, your purchase of merchandise, your communication with Bendy Fitness Studios, and your use of and attendance at the facilities, where Bendy Fitness Studios’ classes are held.

WE RESERVE THE RIGHT TO MODIFY THESE TERMS AND CONDITIONS AT ANY TIME. SUCH MODIFIED TERMS AND CONDITIONS WILL BECOME EFFECTIVE UPON OUR POSTING SUCH TERMS AND CONDITIONS TO THE WEBSITE.

PHOTOS, VIDEO AND MARKETING

You acknowledge that Bendy Fitness Studios may use my image and likeness in marketing materials which may appear on social media, the website, and other mediums. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

PRIVACY POLICY

Any personal information that we collect about you will be treated in accordance with our Privacy Policy.

AGE & HEALTH REQUIREMENTS

Bendy Fitness Studios does not accept online bookings or other purchases made by minors, and by visiting this Website and purchasing and participating in classes offered by Bendy Fitness Studios, you represent and warrant that you are 18 years of age or older.

It is your responsibility to ensure that you obtain proper and detailed medical advice prior to participating in any of our classes.

We will not be obligated to provide you with a refund if you are unable to complete a class due to your health, fitness or other physical limitations.

CLIENT CANCELLATIONS, RESCHEDULING AND TRANSFERS

All Bendy purchases are final and non-refundable.

Drop-in classes
Non-refundable. Drop-in bookings cannot be moved to another date. A drop-in that is cancelled or not attended is forfeited, regardless of when notice is given. A drop-in spot may be given to another person once, with at least 24 hours written notice to hello@bendyclass.com, subject to space.

5-class packs
Non-refundable. Packs expire 60 days from the date of purchase, and any classes remaining after that date are forfeited. A booking made with a pack may be cancelled and rebooked with at least 24 hours written notice, subject to space. A booking cancelled with less than 24 hours notice, or not attended, is forfeited and the class is deducted from the pack. A pack spot may be given to another person once per individual class booking, with at least 24 hours written notice to hello@bendyclass.com, subject to space.

4-week programs
Non-refundable. Students may reschedule one missed class per program at no cost, with at least 24 hours written notice to hello@bendyclass.com. The make-up may be taken in any other scheduled Bendy class within 30 days of the missed class, subject to space. A make-up not used within 30 days is forfeited. Classes missed without 24 hours notice, and any missed classes beyond the one permitted reschedule, are forfeited. A program enrollment may be transferred in full to another person before the first class of the cycle, and cannot be transferred once the program has begun.

2-program bundles
Non-refundable and non-transferable. Bundles expire 90 days from the date of purchase, and any unused portion after that date is forfeited. Each program within the bundle includes one free make-up class under the same terms as the 4-week program policy above.

CANCELLATION BY US

If Bendy cancels a class, the value of that class will be refunded to the original payment method. For classes purchased as part of a program, pack, or bundle, the refund will be pro-rated based on the per-class value of that purchase.

APPROPRIATE BEHAVIOUR

At all times, you shall behave in a respectful manner towards other individuals and staff while at our facilities, and comply with all verbal instructions given to you by our instructors, as well as stated and customary terms, posted safety signs and rules. If any of our instructors determine (in their sole discretion) that your behaviour is causing or is likely to cause harm, distress, danger or annoyance to any other individuals (including, but not limited to, clients and staff) at our facilities, or damage to property, the instructor may direct you to leave our facilities immediately.

SEVERABILITY

In the event that any term or condition contained in these Terms and Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

APPLICABLE LAW

These Terms and Conditions and all disputes connected with or related to them, including but not limited to related claims in tort, equity or otherwise, shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
